§ 1 User

§ 2 Scope

These General Terms and Conditions apply to all legal transactions between the user and a consumer (according to § 13 BGB, a “natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity”).

§ 3 Conclusion of Contract and Storage of the Contract Text

The provisions of these GTC apply to orders placed by consumers through the website www.cafe-wallner.at of the online shop "Wallner’s Lebkuchen Shop."

The contract is concluded with the user (see § 1).

The presentation and description of goods on the Konditorei Wallner KG website www.cafe-wallner.at does not constitute an offer to contract.

By placing an order by clicking on the “Order with obligation to pay” button at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is only concluded when the user sends a confirmation of the order by e-mail.

The contract text is stored for orders. Consumers receive an email with the order details. After the contract is concluded, the order details are no longer accessible online.

§ 4 Payment

The statutory value-added tax and other price components are included in the stated prices. Shipping costs are not included in the displayed price and may incur additional charges.

Consumers have the following payment options available:

  • EPS Transfer
  • iDeal
  • Bancontact
  • Prepayment


§ 5 Delivery, Delivery Restrictions

Delivery is made—unless the description of a selected product explicitly states otherwise—within approximately 2-5 business days. This period begins in the case of payment by bank transfer or PayPal on the day following the issuance of the payment order.

§ 6 Transfer of Risk

The risk of accidental deterioration or accidental loss of the goods remains with the provider until the goods are handed over to the consumer, and transfers to the consumer upon handover.

§ 7 Retention of Title

The provider retains ownership of the goods until full payment of the purchase price is received.

§ 8 Warranty

The statutory warranty regulations apply.
